He explained that in 1988, Mr. Vassallo
was told by staff that he could do a three-lot split on his
father's property, which Mr. Vassallo was unable to do at that
time. Mr. Harvey stated that at his first meeting with the
Planning staff on the Vassallo property in March 1989, he was told
that the property could be subdivided into three lots but that the
Planning Department would like the Cerruti property developed at
the same time. He continued that a purchase agreement was worked
out with Mr. Cerruti, followed by five months of discussions with
the Planning staff regarding the project, during which times new
conditions were added. By November 1989, the project was surveyed,
the tentative map and architectural designs of two homes as well as
the soils and arbor report were completed, and the landscape design
was started. It was at this time that the new planner assigned to
the project indicated that amenities had to be added to the project
and that the City favored a five-lot development for the area. Mr.
Swift then reviewed the issues of the General Plan, stating that
the proposal should be submitted as a five-lot PUD and address the
amenity issue. Mr. Harvey continued that in May 1990, he was told

9-4-90

- 6 -
