141

the residence is in the path of a runway. He stated the Airport is an
economic necessity to the area and he urged Council to work with the City of
Livermore to enhance the airport's contribution to the community. He felt it
would be a poor move to close the Airport at night; there is no evidence that
tower control has a significant effect on safety operations.

Mayor Mercer stated this issue started in April or May last year when he
received a call from Pleasanton Meadows representatives stating they felt they
had not made any progress in trying to work with the City of Livermore regard-
ing aircraft flying over their homes. He stated he met with the Pleasanton
Meadows Homeowners and the Livermore Airport Commission and he did not feel
anything positive was done. He asked the Pleasanton City Attorney to meeting
with the Livermore City Attorney to get air traffic to make 45 degree right
and left turns so as to avoid the Pleasanton Meadows area. In a summary from
the City of Livermore it was their preliminary opinion that there was no sig-
nificant difference in liability exposure between directing traffic left or
right as in their present program, but because of technical reasons this ac-
tion is not safe. He stated he and the citizens met further, going through
the process, and received a letter from Ray Brice with good suggestions
regarding notifying all property purchasers of the airport's traffic increases
and additional noise mitigation as well as signs at the end of the runways
stating to avoid residential area safety permitting.

Mayor Mercer stated that during the holidays citizens and he called in
complaints; one pilot flew so low over the Sports Park Mayor Mercer could see
the pilot's face - the pilot advised he was hired to take pictures. He stated
one cannot get through to the Airport Commission on weekends to make com-
plaints. He stated that Livermore pilots have been extremely cooperative, it
is the weekend pilots that are the problem. If air traffic turned left or
right that would solve the problems. He stated the City of Pleasanton wants
to cooperate, but this seemed the only way to get the issue settled - the con-
cerns of the Pleasanton Meadow homeowners are legitimate.

Councilmember Wilson stated he could support the resolution by eliminating
Section 2 - closing of the Airport at night, and Section 6 - requesting a de-
lay on the runway expansion until the environmental update is complete; and
adding a new section to require Livermore City Council to pass an ordinance
that commercial airplanes could not use the Airport in the future.

Councilmember Butler stated he strongly supports the elimination of Sec-
tion 2. He would prefer Section 6 be left in and amended such that the En-
vironmental Impact Report focuses on capacity of the runway and addresses pos-
sible impact of the planned expansion.

Councilmember Brandes stated there have been gross violations and he would
like to take steps beyond the proposed resolution to ensure that special legal
action to abate noise and safety hazards can be taken in the future.

Councilmember Wilson suggested that citizens call the Police Department
when there are complaints against airplanes, in order to get a better record
of the problem. Mayor Mercer stated that normally the complainant cannot give
the number of the aircraft; he suggested calling both the Police Department
and the Airport tower.

9 - 3-15-88
