NOES: Councilmembers Butler, Mohr, and Wilson
ABSENT: None

CITY COUNCIL COMMITTEE REPORTS
There were no City Council Committee Reports presented at this meeting.

MEETING OPEN TO THE PUBLIC
Mr. Ken Metzler, 6273 Robin Court, stated that 63 residents in the Val
Vista area had received notices of violation on the illegal parking of their
recreational vehicles, which he felt was unfair. He stated that apparently
-- the compliant had been filed by an anonymous female; it is not known where she
lives or if she has a possible interest in RV storage. He advised that none
of the neighbors are opposed to the parking of these vehicles.

Mr. Swift explained that the Planning Department received a complaint that
there were illegally parked boats, campers, and trailers in the Val Vista
area. He advised that the caller requested to remain anonymous. He reviewed
the ordinance and stated that it is enforced on a complaint basis; the Plan-
ning Department is required to investigate any citizen complaint and make
whatever citations are legal and proper. He stated that members of his de-
partment investigated and found the 63 violations, then sent notices to the
It) persons in violation of the ordinance. He stated that a copy of the ordinanc
~. was not attached to the letter but that they could call his office and receive
~=1 information regarding the regulation.
') Mayor Mercer stated the ordinance was enacted only after much public tes-
I'I"1 timony and Council consideration to come up with the most fair and equitable
~ solution to the recreational vehicle parking situation. He stated that if the
ordinance is not suitable for a certain neighborhood such as Val Vista because
of unique conditions, then Council should review the ordinance to see what can
be done to solve the problems.

Councilmember Brandes stated that some developments have rules and regula-
tions regarding the parking of recreational vehicles written into their
CC&R's, which cannot be changed by the City. He added that any person has the
right to remain anonymous when making a complaint; and that there are a lot of
citizens in this town who feel strongly that recreational vehicles should not
be allowed to park outside their property.

Mr. Dan Olson, 6480 Inglewood Drive, asked what does it take to change the
ordinance. He stated many of the lots in Val Vista are not large enough to
park boats, trailers or campers on the property. Mayor Mercer explained that
Council can change the ordinance but it must be a scheduled item on the agen-
da; no action can be taken on this matter tonight because of the Brown Act
rules.

Ms. Judy Livingstone, 6298 Alvord, stated her lot would not accommodate
the parking of her RV on site; it would block access to the PG&E meter. She
advised she does not want to pay storage fees to park her RV in some other
location. She felt the people should have the right to know who made the com-
plaint against them.

Mayor Mercer asked what the penalty is if the people to not comply with
the ordinance. The City Attorney advised this is an infraction; the first
violation is $100.00 plus State penalties of approximately $70.00.

6 - 5-5-87
