Mr. Paul B. Grant, 597 Rowell Lane, presented a petition signed by 30 residents
in the area, requesting a public access to Kottinger Park via Rowell Lane as a result
of the Park Place Development (PUD-80-13) dated November 22, 1983, for the following
reasons: (1) Kottinger Park is a public area which should be accessible to residents
of the community as a whole not only those that border the park itself; (2) closure
of this public access would increase the usage of the current accesses at the top of
Gerard Court and between Mavis and Valley View School. This is particularly important
with the addition of 18 new families in the Park Place development (PUD-80-13)~ (3)
with the addition of the 18 new families in the Park Place development it would be
much more desirable to have our children playing in the Parks for which they were in-
tended rather than the streets; and (4) the public access is an enhancement to the
community not a detriment. All of the other neighborhoods which border greenbelt
areas have an access to those greenbelt areas. This is an enhancement not a detriment.

After discussion, it was moved by Councilmember Wood, and seconded by Council-
member Mercer, that Resolution No. 83-524, after finding that, in accordance with
Section 66472.1 of the Government Code (Subdivision Map Act), there are changes in
circumstances which make the condition of the access to Kottinger Park no longer
necessary, and that modification of said condition to remove the 12 foot wide public
service easement does not impose any additional burden on the present fee owner of
the property affected or nearby future or present residents of Tract 5004, authoriz-
ing staff to execute and record the appropriate certificates of correction, approved
by the City Attorney, eliminating the 12 foot wide public service easement between
Lots 16 and 17, Tract 5004, subject to appropriate changes in the PUD being approved,
be adopted.
The ro!l call vote was as follows:
AYES: Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler
NOES: None
ABSENT: None

REPORTS OF THE CITY ATTORNEY
Consider Long Term Agreement with Morrison Homes
This item was considered after item 8d on the agenda.

Consider Development Deferment Agreement with Stoneson Associates relating to Tract
3150
Mr. MacDonald presented his report (SR 83:514) dated November 16, 1983, regarding
this matter.

Ms. Carol O'Neil, representing Stoneson Corporation, concurred with the staff
report.

It was moved by Councilmember Brandes, and seconded by Councilmember Mohr, that
Resolution No. 83-525, approving the second amended Development Deferment Agreement
with Stoneson Development Corporation regarding Tract 3150, be adopted.
The roll call vote was as follows:
AYES: Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler
NOES: None
ABSENT: None

COMMUNICATIONS
There were no communications presented at this meeting. ,

CITY COUNCIL CALENDAR
Mr. Walker presented the City Council Calendar for the information of the
Council.

16. 11/22/83
