by a vote of 5-Ayes, it was continued from the meeting of November 25, 1980, at
the request of staff, and it is now in order to adopt the ordinance.-

It was moved by Councilmember Kephart, and seconded by Councilmember Wood, that
Ordinance No. 946, amending Title IV by adding Chapter 9 (Noise Regulation) and
amending Title I, Chapter 1, Section 1-1.15 making violations of that chapter an
infraction, be adopted.
The roll call vote was as follows:
AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer
NOES: None
ABSENT: None

~.option of Ordinance No. 953~. ~mending Title IV~ ~bap~er 2~ Article 7~ Section
4-3.18 limiting card rooms to one and Section 4-3.28 limitin~ card rooms to one
already in existence
(Contd. from 12-9-80)
Mayor Mercer stated that Ordinance No. 953 was introduced on December 9, 1980,
by a vote of 4-Ayes, 1-Absent, and that it was now in order to adopt the ordinance.

The City Attorney stated that since the introduction of this Ordinance on
December 9, 1980, an application had been received for a card room permit. He
advised that Council should adopt Ordinance No. 953 on an urgency basis, based
on the following findings:

WHEREAS, the operation of card rooms attracts gamblers and bertors from outside of
the community, increases the potential for police problems, encourages
gambling by many who can least afford it, contributes heavily to police
work load during nighttime hours when police surveillance is severely
limited (thereby reducing the police services in other areas of the city),
and is a nuisance to neighboring uses; and

WHEREAS, the operation of card rooms has been reviewed several times by the City
of Pleasanton, at which times the recommendation from the police depart-
ment and other staff has been to eliminate card rooms as legal uses be-
cause of the adverse effects such operations have on the community, but
at which times the City Council has adopted regulations which prohibit
any additional card rooms in the City while allowing the two existing
card rooms to remain in operation; and

WHEREAS, the existing ordinance allows two card room permits in the City, the
number of card rooms in existence upon adoption of the ordinance, so as
to not allow any expansion of card rooms but also to not require abate-
ment of uses then lawfully in existence; and

WHEREAS, one of the two card room permits has lapsed and the card room is not
presently in operation~ and

WHEREAS, the intent of the existing card room ordinance is to prohibit any new
card rooms in the City, allowing only those in existence to remain so; and

WHEREAS, amending the ordinance by reducing the number of allowable permits to one
is consistent with the spirit of the ordinance itself by limiting the
number of permits to the number of card rooms in existence, there being
only one card room currently operating in the City; and

8. 12/23/80
