After discussion, Mayor Mercer declared the public hearing continued open on
the adoption of an ordinance amending Title II, Chapter 1 by adding Article 13
(Contominium, Townhouse and Stock Cooperative Conversions) to the meeting of
February 10, 1981, 8:00 P.M., at the Fairgrounds Cafeteria.

Mayor Mercer instructed staff to include mobile homes in the proposed ordinance.
He also instructed staff to notify the Southern Alameda County Board of Realtors,
all homeowners associations, and the people in attendance at this meeting of the
meeting on February 10, 1981, and to send them a copy of the modified proposed
ordinance.

After further discussion, it was moved by Councilmember Mohr, and seconded by
Councilmember Wood, that Ordinance No. 955, to be read by title only and waiving
further reading thereof, establishing a moratorium on conversion of existing
multiple family rental dwellings, including mobile home parks, to condomtniums,
be adopted as an urgency measure.
The roll call vote was as follows:
AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer
NOES: None
ABSEnt: None

Mr. Bill Hirst, 147 Bernal Avenue, stated he did not object to a moratorium
but strenously objected to not allowing those applications pending or for property
owners considering conversion to file and complete their applications. He stated
he did not feel this is fair because of previous action of the Council in adopting
the condominium conversion ordinance. Mayor Mercer explained that when the condo-
minium ordinance was first considered it was thought by Council the rate of con-
version would be very low but this had not been the case and that now Council
feels that more information should be received and this matter re-evaluated.

Mr. Harris reviewed the list of complexes that would not be affected by the
moratorium as follows:

1. 8-plex on Rose Avenue
2. 4-plex on Kottinger
3. 5-plex on Hansen
4. 6-plex in Fairlands

Mr. Harris advised that the following complexes would not be allowed to convert
under the moratorium:

1. 26-unit complex on Division Street
2. 73-unit complex on Santa Rita Road near Century House.
3. 4-unit complex on Sonoma Drive

Mayor Mercer again advised ~hat the public hearing on this item will be considered
at the City Council meeting of February 10, 1981, and that the moratorium on condo-
minium conversions will be in effect for four months or until action is taken on the
proposed amendment to the ordinance.

MATTERS CONTINUED FOR DECISION
Adopt.~on of Ordin~p~e No. 946, amending Title IV by a.dding C~apter .9 (Noise Regula-
tion) and amending Title IL~hapter 1~ SectiOn 1~1.15 ~aking violations of that
~bapter an infraction
(Re-Introduced 11-17.~8q, 5-Ayes)
(Contd. from 11-25-80)
Mayor Mercer stated that Ordinance No. 946 was re-introduced on November 17, 1980,

7. 12/23/80
