to the site. He asked if staff was comfortable saying that by September 1, 2003 adequate
infrastructure would be in place for them to start construction?

Mr. Grubstick said yes as far as water is concerned. The difficulty with the loop road is
that the upper portion of the loop road was incorporated into the parking lot of the school. As
staff analyzed the traffic flow through the area, it was determined that bringing traffic through
that parking lot would not work. Other options are being considered to make the loop road
independent from the parking lot and yet trying not to impact the original design of the parking
lot.

Mayor Pico asked if a follow-up report could be available at the first meeting in January?

Mr. CJrubstick said that would not be a problem.

Ms. Hosterman assured the community she would do everything she could to support the
building of Neal School. She felt it was tragic that the school has not already been built and the
way the Ruby Hill residents have been treated. The original intent of these agreements was to
provide facilities as needed. There is a need for that school. She said she likes and relies on
facts. She quoted from the 2002 Growth Management Report, which indicated the school
population has grown. More housing will be constructed and will generate larger than average
numbers of school children. In addition, existing housing also generates many children. She
quoted from other sections and a table of school populations, all of which indicated there is a
need for the proposed Neal Elementary. She encouraged the other Councilmembers to direct
staff to do everything possible to get the school built.

Mr. Campbell ask who makes the ultimate decision on whether the school is built?

Mr. Roush replied that is the School District's responsibility. The City, as a party to the
agreement, contemplated that the school would be built as early as 2002. Ultimately, however,
the decision is from the School Board.

Mr. Campbell agreed that the City needs to do whatever it can within its jurisdiction to
make sure the school is built: roads, utilities, etc. The point he has an issue with is the City
loaning money to the District to cover operating expenses for Neal School. Does that mean the
City would then be involved is such things as hiring a new principal, being liable for injury to a
student, etc. Is the City now liable because it is a party to providing operating expenses?

Mr. Roush said the City would not be liable. It would be the same situation as the
Financing Agreement, which provides a guarantee on the Certificates of Participation. The City
would guarantee for a short period of time to cover a shortfall in funding. That does not mean
the City would be involved in fundamental District decisions or assuming liability for injuries on
School District property.

Mr. Campbell asked if the City had ever given loans to the School District or any other
agency for operating costs for a particular school?

Pleasanton City Council 19 12/03/02
Minutes
