Ms. Ayala asked if the preannexation agreement goes with the land or the signatory.

Mr. Roush said the agreement is recorded and runs with the land and any subsequent
property owners.

Mayor Pico said the agreement provides the owner will not protest any future annexation.
It does not say they have to vote in favor of an annexation. He asked if the City could require a
yes vote if there were an annexation election.

Mr. Roush said he interprets that to be a positive vote at an election.

Mayor Pico declared the public heating open.

Vince Barletta, 6290 Laura Lane, President of the Alisal Improvement Club, said
originally water and sewer were only to be installed on Alisal Street unless 70-80% of the
residents on the side streets committed to connection to the utilities and their associated costs.
Because of the cost, it was assumed most of the residents would not get utility connections. The
City had worked with developers to bring utilities to the area, but the residents felt so strongly
about the bypass road that they voted against annexation even though it meant the loss of water
and sewer infrastructure. People still have water and sewer concerns and he did not think there
were any plans to monitor water quality at any residence. No one has the opportunity to get
water and sewer except those on Alisal unless that 80% commitment is reached. At one point,
developers committed funds for the infrastructure and received increased housing density to fund
some of the infrastructure. He asked where those funds were now. He strongly urged Council to
direct staffto build out the infrastructure as it is designed with all the side spurs. In that way, the
streets would be torn up once. At some point, he felt the differences between the City and the
residents of Happy Valley will be settled and it did not make sense to go back and tear up streets,
or to install the utilities piecemeal.

Mr. Campbell asked which Option he favored.

Mr. Barletta said it was up to the City, but if the infrastructure is there, you can later
decide how people can connect to it.

Mr. Bmzosky realized the lines would be stubbed at each household and asked how the
lines would be constructed in the street?

Mr. Grubstick said staff plans to reconstruct Alisai Street as the utility lines are installed
in the street. The plan calls for each utility main to be stubbed to each cross street. At this point,
the lines are not to be installed in the cross streets. Sewer and water laterals will be provided to
each home and lot on Alisal so the street will not have to be torn up later.

Vanessa Kawaihau, 811 Sycamore Road, stressed her desire to maintain the Happy
Valley Specific Plan and save money by installing core infrastructure now to the Happy Valley
loop side streets. She was concerned the staff report failed to mention decreasing the housing
density allowed the developers who were to provide the infrastructure on Happy Valley Road.

Pleasanton City Council 9 12/03/02
Minutes
