Mr. Swift said that could be done.

The public hearing was opened.

Patrick Curdn, 5043 Hillcrest Way, said it has been two years since the EIR had
been certified, which was the first step to get this project underway. He agreed with the
Planning Commission conditions, with the exception of the public access condition.
Staff's reason as to why that condition is inappropriate is primarily a legal one and he is
in full agreement. There are also private rights of access for all of the homeowners that
live in Oak Tree Farm. He believed that the residents would have to agree to waive that
right before he would be allowed to grant such an easement. It is unpopular with the
present residents for any access easement. There is another location for this and this
access was never designed for such a use. There is no parking for the public at Oak Tree
Farm. The way the trail goes through the property comes very close to residents' back
and/or front yards.

There being no further speakers, the public hearing was closed.

It was moved by Ms. Ayala, seconded by Mr. Brozosky, to (1) f'md that there
are no substantial changes to the project or circumstances surrounding the project
since the SEIR was certified and that the project incorporates ail relevant, feasible
mitigation measures identified in the SEIR; (2) i'md that the PUD development plan
is consistent with the General Plan and the purposes of the PUD ordinance; and (3)
introduce Ordinance 1892, Approving the Development Plan for Case PUD-17,
subject to the conditions listed in Exhibit B.

The roll call vote was as follows:
AYES: Councilmembers Ayala, Brozosky, Campbeil, Hosterman and
Mayor Pico
NOES: None
ABSENT: None
ABSTAIN: None

Item 6e
Review of the Tri-Valle¥ Needs Assessment Report prepared by ICF Consulting-
Inc. (SR 03:248)

Eileen Morley presented the staff report.

Ms. Hosterman noted the additional information presented to Council by way of
copies of email messages received.

Ms. Morley said the next step is to look at solutions regionally and to look at
individual cities. Pleasanton can look at youth-at-risk and child care issues. Regional
advocacy is another aspect to be investigated because of state and federal funding.
