6. PUBLIC HEARINGS AND OTHER MATTERS

Item 6a
Review of Amendments to the Capital Improvement Pro~ram {CIP} for Fiscal
Years 2003-2004 through 2006-2007~ includinll the Railroad Avenue Fire Station~
the Bernal Property. Improvement Reserve, and Happy Valley By-Pass Road
(SR 03:206)

Steve Bocian presented the staff report.

Mr. Brozosky asked about the reuse of the downtown fire station and thought the
previous Council action was to make sure the money was there for fiscal year 2004-05. It
appeared to him that option 1 was the only option that meets what Council had previously
requested. It appeared to him that a project could begin by 2004-05. Taking the money
now instead of waiting a few years, probably is the fight thing to do. On the Happy
Valley Bypass road, he had questions about the necessity of moving funds.

Mr. Bocian said it was appropriate to move the funds and staff's recommendation
was the most appropriate way to transfer the funds. The issue is the use of the park in
lieu fees. Looking back at the fee study that was done in 1998, the City made an estimate
on the amount of money that would be involved to make improvements to the Bernal
property. At that time that property that the City thought it would receive was to be much
smaller. Accordingly, only $2 million was allocated to the Bemal Property
improvements. Since the project is now much larger, staff feels comfortable in
transferring park in lieu fees above $2 million to the Bemal Property and then using
General Funds for the Bypass road. Staff is uncomfortable at this point taking park in
lieu money and putting it towards the Bypass road. To avoid that conflict, staff is making
an additional transfer so that the City is assured there are not issues with funding that the
City has for the Bypass road.

Mr. Brozosky asked if the Bypass road could not be considered part of the open
space and golf course, which could be considered a park?

Ms. McKeehan said that although it appears that the monies are being moved
three times, it is a way of meeting all of the requirements that the City has in place.

Mr. Roush said this has been looked at and feds that this is the best way to get the
money into the proper funds and still meet all of the legal requirements that are needed in
order to use the funds appropriately.

Ms. Ayala talked about transferring the money directly from the General Fund
and wanted as much money put into the Bernal Property project as possible.

Mr. Bocian said the recommendation is not to adjust the amount of money
earmarked for the Bemal Property.

Pleasanton City Council 5 09.02.03
Minutes
