Mayor Pico declared the public hearing closed.

It was moved by Ms. Hosterman, seconded by Mr. Campbell, to uphold the
appeal subject to the conditions of approval as outlined in Exhibit B, thereby
approving the design review application to allow the construction of the two-story
house with modified house colors and landscape plans.

Mr. Campbell believed the homes in Happy Valley should not look like the other
neighborhoods in Pleasanton.

Mr. Brozosky did not have any problems with the applicant's landscaping plans.
He did not want the City telling applicants how they can landscape their homes. He
pointed out that this house will not be located on a ridge and is not that visible.

A substitute motion was made by Ms. Ayala, seconded by Mr. Brozosky, to
approve the project subject to the conditions as outlined in Exhibit B and allowing
the applicant to use the original landscaping plans and colors for the house and
accessory structure.

The roll call vote was as follows:
AYES: Councilmembers - Ayala, Brozosky, Campbell, Hosterman, and

Mayor Pico
NOES: None
ABSENT: None
ABSTAIN: None

Approval of a Consultant Contract with Mundie & Associates to prepare the
Environmental Impact Report (EIR) for the Kottinger Hills PUD Development Plan
(PUD-33). (SR 04:122)

Brian Swift presented the staff report.

Mayor Pico invited public comments.

Martin Inderbitzen, 70'77 Cole Center Parkway, representing the applicant,
encouraged Council to authorize the contract so that the environmental impact review
process may begin. He pointed out that the environmental impact report is an
informational document and the process allows the applicant an opportunity to develop
factual information and detail about the scope of the project and the impacts it would
have on a variety of issues. The EIR process allows for a high level of interaction with
the neighbors. It also allows the citizenry the opportunity to interact with the consultant
so that information about the project may be disseminated accurately. He believed it
would be appropriate and fruitful in this situation for all of the decision makers, City
Council and the Planning Conunission, to participate in a scoping process as a way to
gain more information and ideas into the consultant's initial work.

Pleasanton City Council 31 05/18/04
Minutes
