Ms. Ayala mentioned that she had asked some time ago about the placement of
wells, how many and where they are located on the Bernal property.

Mr. Cusenza said that this project has identified very large, broad well field sites,
one of which is on the Bernal property. Zone 7 has not specifically identified the location
of the well.

Ms. Ayala asked if Zone 7 would come back to Council for approval regarding
the location of the wells?

Mr. Cusenza said not specifically. If Zone 7 owns the property, it has the right to
put those facilities on its property.

Mr. Brozosky asked if Zone 7 owned any of the Bernai properly?

Mr. Wilson said that it was staff's belief that Zone 7 would have to conduct a
follow up environmental impact report to look at the specific impacts of where the wells
are actually located. He noted that staff would include in the letter the fact that this is a
program and not a project specific environmental document.

It was moved by Ms. Hosterman, seconded by Mr. Brozosky, to accept the
report and direct staff to send a response letter to Zone 7 addressing Council's
concerns related to its Well Master Plan Draft Environmental Impact Report while
making sure that the City's legal options are protected.

The roll call vote was as follows:
AYES: Councilmembers - Ayala, Brozosky, Campbell, Hosterman, and

Mayor Pico
NOES: None
ABSENT: None
ABSTAIN: None

7. MATTERS INITIATED BY COUNCIL

Ms. Ayala asked if there was any interest to explore the mitigation measures that
were adopted by the City of Dublin for its East Side Specific Plan, particularly as it
pertained to the IKEA development and all of the development that is occurring in that
area. She would like to know if all of the mitigations have been implemented.

Mr. Brozosky indicated his support.

Mayor Pico mentioned that the City of Pleasanton challenged unsuccessfully the
City of Dublin's East Side Specific Plan. At the same time, the citizens of Dublin placed
an initiative on the ballot with regard to the East Side Specific Plan, which was approved.
He believed that the City's opportunity to comment, modify or mitigate the IKEA plan

Pleasanton City Council 35 05/18/04
Minutes
