(SR 04:118)

This item was continued to June 1, 2004.

41
Zone 7's Well Master Plan Draft Environmental Impact Report (SR 04:120)

Mr. Brozosky was concerned about what Zone 7 is doing with its wells, how it
will affect the City of Pleasanton's water quality, and how it could potentially affect the
ratepayers.

Mayor Pico believed it was more effective for Council to discuss its response to
Zone 7 with respect to the environmental impact report.

Ms. Hosterman asked Council if it had any concerns with the draft response letter
to Zone 7 concerning its Well Master Plan Draft Environmental Impact Report.

Mayor Pico believed it was appropriate for Council to take an aggressive position
so that the City can raise issues in the future. He believed the letter could be made
stronger to raise the issues that were mentioned by Mr. Brozosky.

Steve Cusenza, Utility Planning Manager, said that the review period ends on
May 28. Staff wanted Council and the community to understand the issues. He noted
that the letter could be revised to include Council's comments and concerns.

Mayor Pico believed the issues were to strengthen the response letter to provide
the City grounds if it wished to legally challenge something in the future. He believed
that the City is operating without an agreement, which has been the case for many years.
He noted that there are concerns about the City's responsibilities and obligations.

Based on Council's comments, Mr. Wilson said that staff would review the draft
letter again from a legal aspect. He noted that staffhas included technical comments,
policy related comments, and comments that are specifically related to the environmental
impact report.

Pleasanton City Council 34 05/18/04
Minutes
