Zone 7 which would, in the judgement of the State,
materially impair Zone 7's capacity to make required
contractual payments to the State.

(2) The State shall make no other contract to supply
SWP water for use within Zone 7 without the consent of
the Board of Directors of Zone 7.

(3) The State shall make all reasonable efforts to
perfect and protect water rights, and must report at
least every five years on its ability to meet future
demands for SWP water.

(4) In the event of a temporary shortage of SWP water
there will be a reduction first in the delivery of
water for agricultural purposes by an amount not to
exceed 50% in any one year or a total of 100% of one
year's agricultural entitlement in any series of seven
consecutive years. Any additional reductions required
will be apportioned among all contractors irrespective
of use.

(5) In the event of a permanent shortage of SWP water
there will be a proportionate reduction of water
delivered to all contractors. In such an event,
Zone 7 may use aqueduct capacity not used for SWP
water to transport other water that Zone 7 may procure.

(6) The State is required to take all reasonable
measures to make available water which meets water
quality objectives set forth in the contract. The
State is, however, not liable for damages arising from
water shortages due to causes beyond its control.

(7) If there is a supply of SWP water in excess of
the entitlement rights of all contractors, such
surplus water may be purchased at a price equal to, at
a minimum, variable operation, maintenance, and power
costs incurred in providing the surplus water.

Zone 7 Local Water Supply. In addition to SWP water
supplies, Zone 7 has local surface water and local groundwater
supplies. Locally conserved surface water runoff is stored in
Lake Del Valle. The average annual volume of water available
to Zone 7 under its Lake Del Valle water rights is 8,000
acre-feet. With respect to water supply in the local
groundwater basin, Zone 7 staff estimazes an annual yield of
approximately 12,000 acre feet under current conditions.

16
