CITY may use Federal-Aid Urban (FAU) funds for all oc- ~ <br />a portion of its share of the construction costs. <br />(4) STATE is willing to bear the entire cost of <br />right of way services, preliminary and construction engineering <br />costs, and 45.5 percent of the construction costs of PROJECT <br />not borne by FAI funds, as shown on Exhibit B. <br />(5) This Agreement sets forth the terms and <br />conditions under which rights of way are to be acquired and unde~i~ <br />which the PROJECT is to be designed, constructed, financed and <br />maintained. <br />SECTION I <br /> <br />(1) To perform at STATE's sole expense, the <br />necessary right of way engineering, appraisals and negotiations <br />required to acquire in CITY's name the additional rights of way <br />required for the PROJECT. <br />* * * * * * * * * * * * * * <br />* ~ * * <br />-2- <br />
