2. Resolution of Disputed Cases If a dispute arises over
whether the District or the City should assume primary
investigative responsibility in a criminal case, the dispute shall
be resolved in accordance with the following procedures.
a. The District shall assume immediate and primary
responsibility whenever the offense has occurred on the Properties.
The City may provide reasonable support and cooperate in the
investigation, consistent with its other law enforcement
priorities. The District, to the extent feasible, shall
accommodate any request from the City to conduct a parallel
criminal investigation.
b. At the earliest opportunity, the City and District
Chiefs shall meet and review the disputed case. The purpose of
the review shall be to determine jurisdiction in future similar
cases. In reviewing the case and resolving the jurisdictional
question, both Chiefs may consider pertinent provisions of this
agreement and those contained in the Alameda County Chiefs of
Police and Sheriff's Association's "Coordination of Police Service
Guideline" (adopted February 5, 1987 and attached hereto). If the
review does not result in agreement, the position of the City Chief
shall prevail.
3. On-aoina Communication and Routing of Reports Both the
District and the City acknowledge the importance of on-going
communication at all levels, and commit to implement procedures to
assure such communication.
a. The District and the City shall route copies of all
crime reports or reports of significant contacts with criminal
suspects whenever such reports may be of possible benefit or
interest to the other agency. In appropriate circumstances,
telephone notification shall me made to expedite the exchange of
important information.
b. District and City criminal investigators shall confer
regularly on any cases or subjects of mutual interest.
c. District and City supervisory and command staff shall
confer regularly to ensure high levels of cooperation and
coordination between the two agencies.
