b. The City will advise the District whenever it decides
to undertake any law enforcement efforts, other than routine patrol
checks, on the Properties. Unless good cause exists for each
agency to act independently, joint operations shall be preferred
to address especially serious problems or problems where a joint
approach is likely to prove more effective.
4. Special Events. The District shall advise the City of any
special events planned on the Properties which are likely to create
public safety problems. Normally, the District will allocate
sufficient resources to manage any such events, but may at times
request support from the City to manage any spillover onto adjacent
streets and neighborhoods.
5. Incidental Patrol of and Response to Incidents on Ridge
Properties. The District agrees to conduct helicopter patrol
checks of the City's jurisdiction adjacent to District Properties
on Pleasanton Ridge. These checks will be made incidental to
regular District patrols. Except for situations that require
immediate law enforcement intervention (e.g., violent or serious
felony crimes), the District shall notify the City of any problems
or violations observed during such patrols. Further, at the
request of the City, District helicopters will assist in providing
the City prompt access to its ridgelands or respond to emergencies
when the City response will be delayed, consistent with other
District operational priorities.
C. Investigation of Major Criminal Cases
1. Primary Investigative Responsibilities The District shall
have primary investigative responsibility for all crimes occurring
on the Properties, with the following exceptions.
a. The crime is related to an on-going City investigation
and should be consolidated or coordinated closely with that
investigation, or the case is of significant interest to the City.
In such cases, the District shall cooperate fully and proceed with
all necessary investigative steps until the City is able to assume
primary responsibility for the case. A joint investigation may be
conducted if the District and the City agree that such an approach
is desirable in a given case.
b. The City has responded to or on-viewed an incident and
initiated a criminal investigation, pending a response by District
units, and the investigation has developed to the point where
transfer of responsibility is not practical or results in
significant duplication of effort. Nothwithstanding these
considerations, the District may still choose to assume
responsibility or the City may request the District to do so.
