Guidelines for the Exercise of Concurrent
Policing Jurisdiction on East Bay Regional Park
Properties in Pleasanton, CA
Date: February 8, 1990
A. Purpose and Scope
1. The purpose of this agreement is to establish guidelines
and procedures for the exercise of concurrent policing jurisdiction
at Shadow Cliffs Recreation Area and a portion of Pleasanton Ridge
Regional Park (hereafter the Properties) in Pleasanton, CA. Both
Properties are operated by the East Bay Regional Park District,
which also maintains and operates its own Department of Public
Safety (hereafter District) under authority of Public Resources
Code Section 5558. The City of Pleasanton operates a full-service
municipal police department (hereafter City) with concurrent
jurisdiction over law enforcement matters on both Properties. The
objectives of this cooperative agreement are to:
a. Promote inter-agency cooperation on law enforcement
matters and provide a high level of police services to park users,
staff and the neighboring community.
b. Provide prompt, effective response to emergencies.
c. Ensure that jurisdiction in major crimes is assumed by
the most appropriate agency.
d. Ensure that police coverage and response is adequate
to address and resolve any actual or potential law enforcement
problems.
e. Assure high levels of on-going communication and
coordination, including the implementation of joint policing
efforts in appropriate circumstances.
2. Nothing in this agreement is intended to diminish in any
way the powers and authorities vested in the District or City as
a matter of law.
B. Provision of Police Services on the Properties
1. District's Primary Policing Responsibility Although both
the District and the City have concurrent policing jurisdiction on
the Properties, it is agreed that the District shall have primary
policing responsibility. However, in selected instances, the City
shall assume primary responsibility for the investigation of
certain serious, violent crimes in accordance with criteria set
forth in section C.1, subsections a and b.
