A feature of the plan which was overlooked w}~reri it w~zs initially
submitted is that the two warehouse buildings come to within 5 ft.
of the rear property lines of the subject site. `1']ie subject property,
although it is zoned PUD, is subject to the site development standards
of the C-S District and a minimum 10 ft. rear yard setback is required
in that district. The buildings therefore, would need to either be
moved forward 5 ft. or a variance requested for their retention in
their present locations. The applicant has chosen t}~e latter tack
and has filed a variance for the rear yard encroachrlc_nt=. This will
be }reard by the F3oard of Adjustment at their 2/22/£34 meeting. .
A negative dc~r_laration accompanies this report. I3asc~d on the Initial
Environmental Study done for this project it is tlir~ sniff's opinion
that case 7.-84-39 would not have any significant arlvc~rse effects
on the environment. If your Board concurs wit}i this environmental
assessment you must make the findi.nc~ that the necJtiLi.vc declaration
is appropriates Cor the project. '1'}ie finding mush lie ruiae prior to
taking action on t}ie project itself.
Staff Recommendation: T}ie staff feels that t}~e proposed project
would be appropriate for the area in which it would be located.
For this reason, we recommend approval of case Z-84-;~9 subject
to all conditions on the following pages:
