Street. These improvements together are hereinafter referred to <br />as "the sanitary sewer improvements." <br />D. Although sanitary sewer improvements are normally done <br />at the time properties are developed, Developer wishes to defer <br />constructing the sanitary sewer improvements until such time in <br />the future that such improvements are warranted. <br />NOW, THEREFORE, the parties hereto agree as follows: <br />I. DESCRIPTION OF WORK <br />Developer shall plan, construct, finance, or participate in <br />the planning and construction of the sanitary sewer improvements <br />along the First Street frontage of the site said improvements to <br />meet the City's standard specifications, as determined by the <br />City Engineer. <br />II. PAYMENT IN LIEU OF CONSTRUCTION <br />Developer agrees that, if Developer does not install the <br />sanitary sewer improvements described above, Developer shall pay <br />the City, upon written demand by the City Engineer, the cost for <br />the sanitary sewer improvements described above at the time the <br />City, or some other developer, installs said sanitary sewer im- <br />provements. The cost of the sanitary sewer improvements shall be <br />based on contract unit prices and installed quantities for the <br />sanitary sewer improvements required to be installed by Developer <br />plus any pro rata share of incidental costs such as, but not <br />limited to, designing, engineering, surveying and inspection. <br />Payment shall be made within thirty (30) days of the date notice <br />is sent by the City Engineer to Developer at the address desig- <br />nated herein. <br />III.
