Developer, as of the date of this Second Amendment, is <br />the owner of lots 1-6, 9, 14, 15, 31-66, Tract 6023, Kottinger <br />Ranch, Unit III, filed August 10, 1992, Map Book 203, at Pages 4- <br />11, Official Records of Alameda County ("the Property"). <br />B. City and Developer's predecessor in interest entered <br />into the underlying Agreement, dated June 16, 1986, and recorded <br />April 13, 1987, Series #87-10038, Official Records of Alameda <br />County, concerning a growth management development schedule for <br />the Property. <br />C. City and Developer entered into a First Amendment to a <br />Long Term Agreement, dated December 10, 1991. <br />D. City granted to Developer develcpment plar_ approval for <br />66 dwelling units, hereinafter referred to as "the Project." <br />E. Developer obtained growth management approval for the <br />Project under the City's then existing Growth Management Program <br />with the following development schedule: <br />1989 1 unit <br />1990 50 units <br />1991 15 units <br />- 1 - <br />
