WILCOX - GRANT OF EASEMENT AND STORM DRAIN CONSTRUCTION AGREEMENT

5.29.81 C169-020 connection therewith, Grantee proposes, to construct a storm drain for storm, flood and surface water drainage, a portion of which shall be located on the Subject Property (herein- after referred to as the "Storm Drain"). Grantor intends to grant to Grantee, for the bene- fit of the Adjacent Property, an easement for purposes of construction of the Storm Drain and pedestrian and vehicular access to and egress from the Storm Drain during such con- struction over and across a portion of the real property described in Exhibit A hereto .(the "Easement"), and the parties intend to provide for construction of such Storm Drain and repair and restoration of the Easement area. NOW, THEREFORE, it is agreed as follows: ARTICLE I GRANT OF EASEMENT For. and in consideration of the covenants made herein, Grantor hereby grants to Grantee, as an appurtenance for the benefit of the Adjacent Property, the owners there- of, their successors and assigns, an easement over and across a portion of the Subject Property as shown on the map attached hereto as Exhibit C and made a part hereof, (the "Easement Area"), for purposes of construction of the Storm Drain, including pedestrian and vehicular access to and egress from the Storm Drain during such construction, to permit normal operations of Grantee with respect to said Storm Drain, clearance of obstructions and vegetation, as -2-
