5.29.81 <br />C169-020 <br />necessary, and repair and restoration of the Easement Area <br />as provided herein. <br />ARTICLE II <br />EASEMENT FEE <br />For and in consideration of Grantor's grant of the <br />Easement described herein, Grantee agrees to pay Grantor the <br />sum of Fifteen Thousand Dollars ($15,000.00) in cash upon <br />execution of this Agreement. <br />ARTICLE III <br />PERMANENT STORM DRAIN IMPROVEMENTS <br />3.1 Construction. Grantee shall construct the <br />Storm Drain, which shall be sixty-six inches in diameter, in <br />the Easement Area pursuant to plans and specifications in <br />conformance with current governmental requirements for such <br />construction at its own expense. <br />3.2 Repair. Subsequent to completion of con- <br />struction, Grantee shall repair any damage to the real or <br />personal property of Grantor and shall replace any vegeta- <br />tion removed or destroyed during the construction of the <br />Storm Drain pursuant to the landscape plan, attached hereto <br />as Exhibit D and made a part hereof, at its own expense. In <br />addition, Grantee will replace any trees in excess of six <br />(6) feet in height in the Easement Area which die within two <br />(2) years after the construction of the Storm Drain due to <br />causes reasonably related to the construction of the Storm <br />-3- <br />
