THE CITY OF
i
"' iii
-... N i ~I~r
L~~S~4NTON®
October 2, 2006
Jennifer Hosterman
2922 Chazdonnay Drive
Pleasanton, CA 94566
Re: Requirement to Apply for a Conditional Use Permit to Keep Hawk
Dear Ms. Hosterman:
I am writing because a Pleasanton resident has contacted this office regarding your
keeping of a hawk in a structure on your property at 2922 Chazdonnay Drive.
Under the Pleasanton Municipal Code, you aze required to obtain a conditional use permit
in order to keep a hawk at your property. Because there is no record that such a City
permit has been obtained, if you aze in fact keeping hawk at your property, I have
enclosed a conditional use permit application for you to complete and submit to the
Planning Department with the information and fees indicated on the application.
For your information, your home is located in a One Family Residential (R-1) district,
where household pets such as cats and dogs aze allowed without permit. (See Municipal
Code § 18.32.030.F.) However, other animals, including birds "kept in the open or in an
accessory structure" require a conditional use permit. (See Municipal Code §§ 18.08.245
and 18.32.040.x.) Thus, if you do have a hawk living in an accessory structure on your
property, you are required to obtain a conditional use permit.
A conditional use permit is considered by the Planning Commission at a noticed public
hearing. (See Chapter 18.124 of the Pleasanton Municipal Code.) When the Planning
Commission considers such an application, commissioners will consider impacts on the
neighborhood, including regulations related directly to birds, such as requirements that
bird: (i) do not "cause damage or hazard to persons or property in the vicinity or to
generate offensive noise, dust or odor"; (ii) aze not to run or fly at lazge or go on another
person's property; and (iii) that the animal's premises must be clean and sanitary. (See
Pleasanton Municipal Code § 7.36.010 et. seq.)
I regret that if in your prior contact with the Building or Planning Departments you were
given the impression that so long as your hawk's house met setback and height
regulations for your neighborhood, no other City permits or entitlements were needed, as
you already had the proper licenses and permits from the appropriate Federal and State
agencies.
P.
