Commissioner Pearce: My question was going to be about the visual analysis as well. I was
going to direct it to staff as opposed to the applicant. But you got my questions in, thank
you.
Commissioner Blank: I had some questions about the peer review as well, but it is what it is.
Chairperson Maas: I am going to close the public hearing at this point. If something pops up
that is really important, I do not have a problem reopening it. And what I'd like to do is
I'd like to keep it as general as possible, because we're just at the starting gate here. I
think we have some pretty important things to tackle, and that is basically the location
siting, the architecture, and the visual impacts. If we could get our comments or
discussion to those three items and get through those, then we can go on to the more
detailed aspects. So, I would like to jump into the location.
I have been sitting here trying to turn all these maps and trying to figure the asterisk,
which I always felt was a generalization also. But if you want to get specific on the
asterisk, I think it is positioned pretty much where staff has assumed that it should go
think where the asterisk is depicted is exactly where the garage or that other location
should be, and not up at the top.
Commissioner Blank: I think Anne's question is really going to be key to helping me understand
this because I do not know if there is any legal guidance to what that little dot means.
And I remember the issue dealing with Mr. Bozorgzad and the dot. So, if we have set a
precedent or we have been consistent in the past about what the dot means, that would
weigh heavily in terms of my leaning. If, on the other hand, we discover that the dot
really is not meaningful, that it is just a general indication, then I could be more
accommodating to a variation in the site location because the dot is just to show the
general area and whether it is on this side of the hill. The distance, the physical distance
that you walk from the dot to where they are proposing is not that great, but what is the
meaning of the dot?
Chairperson Maas: Well, and I think what also needs to be taken into consideration is the effect
of the placement on the hilltop. If we want to get something in there that we could all
agree on, I would not have a problem with it. But, I do not like that house being situated
on top of that hill.
Commissioner Blank: I think that's different than whether the dot is really is general. Do you
want it on the hill?
Chairperson Maas: I sat on this Commission during the Specific Plan, and I really do feel the dot
is general, but on the other hand, would you approve be in agreement to placing a house
where the applicant wants to set it? That is what I cannot go with.
Commissioner Pearce: I have concerns that it appears it is being referred to as a minor
modification - I cannot see it as a minor modification, moving from where the dot is .
17
