A <br />Project shall be 'deemed finally appr0ved upon approval of an <br />agreement, or other authorization, for preparation of plans and <br />specifications for the Project, or, if applicable, upon approval <br />of the issuance of bonds or other evidences of indebtedness by <br />the Authority, whichever event occurs first. Notwithstanding the <br />foregoing, a Project for a Sole-Use Facility may be disapproved <br />by the unanimous vote of all Directors representing the Parties <br />not proposing the Sole-Use Facility upon a finding by them that <br />the proposed Project is not in the public interest. <br /> <br /> B. Capital Expenditures: Capital Expenditures for a <br />Project shall be allocated between the Participating Members <br />based upon their proportionate allocations of Capacity Rights in <br />the Project. The calculation and allocation of Capital <br />Expenditures for each Project shall be set forth in the Capital <br />Budget for each such Project. <br /> <br /> C. Operation and Maintenance Costs: Operation and <br />Maintenance Costs for a Project shall be allocated among the <br />Participating Members based upon their actual actual use of the <br />Facility or Facilities constructed for the Project determined by <br />measured or estimated volumes of wastewater flow for <br />transmission or disposal Facilities, and such flow and/or other <br /> <br />parameters of pollution, including, but not limited to, <br />biochemical oxygen demand and total suspended solids, for <br />Facilities not related solely to transmission or disposal.
