2) Our main entertainment area is exactly behind
the proposed pool structure. The pool structure
plans call for 3 spillways, one 4' tall waterfall
and a spa a115' from our property line.
3) Our property is approximately 3' lower than the
Spencer's lot. Their proposed pool has a 2' tall
raised bond beam with the 3 spillways would end
up being 4' from our fence with the 4' to 0' area
being a planter for landscaping. There is no
retaining wall planned to protect the fence from
soil buildup and also no French drains are
shown on their plan to eliminate irrigation and
rain from flooding our yard.
4) In July 07 we objected to the pool structure
being so close. The city offered to hire a
mediator, which we agreed to. Even though the
cost of mediation was to be borne by the
Spencers we made an offer to pay 1/2 of the cost.
It has never happened.
5) Our proposal was that the pool location be
moved a minimum of 10' from our property line
with the hot tub moved to the opposite end (East)
border. The east portion of their neighbor's yard
is not used for entertainment as that is the
garage side of their yard.
6) We ask that the waterfall be toned down for
noise relief. This waterfall is currently located
opposite our master bedroom .
7) The Lemoine Ranch Estate HOA has or is filing
for a minor modification to bring the set backs
