COST ALLOCATION AGREEMENT FOR PUBLIC SERVICE EASEMENTS
This Cost Allopation Agreement for Public Service Easements (Agreement) is
entered into this, day of ("Y U 2013 by the City of Pleasanton, a municipal
corporation (City), and the Dublin an Ramon Services District, a special district
(DSRSD).
RECITAL
A. DSRSD is undertaking improvements to its Wastewater Treatment Plant at
7399 Johnson Drive in Pleasanton in its capacity as the entity operating the Wastewater
Treatment Plant for itself and the City of Pleasanton pursuant to the Agreement for
Wastewater Disposal Services between the parties hereto dated November 3, 1992, as
amended to date ("Regional Agreement"), and these improvements include
undergrounding PG&E overhead utility lines and relocating AT&T communications lines
serving DSRSD's facility.
B. DSRSD asked the City to allow the PG&E utility lines and AT&T
communication lines to relocate into portions of the City's adjacent Val Vista Community
Park after PG&E advised DSRSD that PG&E could not underground its utility lines on
the DSRSD site, and AT&T advised DSRSD that AT&T's communication lines also
needed to move off of the DSRSD site.
C. The City Council of the City approved a grant of easement to PG&E for the
benefit of DSRSD on July 19, 2011 - Resolution No. 11-469, which grant of easement
has been memorialized as a GRANT OF PUBLIC SERVICE EASEMENT dated August
12, 2011 and recorded in the Alameda County Recorder's Office as Series No.
2011242305, 2011242306 and 2011242308 (PG&E Easement) and also approved a
grant of easement to AT&T for the benefit of DSRSD on July 19, 2011 - Resolution No.
11-469, which grant of easement has been memorialized as a GRANT OF PUBLIC
SERVICE EASEMENT dated August 12, 2011 and recorded in the Alameda County
Recorder's Office as Series No. 2013147469 and 2013147470 (AT&T Easement).
D. As the PG&E and AT&T Easements are for the benefit of DSRSD in its
capacity as the entity operating the Wastewater Treatment Plant for itself and the City of
Pleasanton pursuant to the Regional Agreement, the City and DSRSD desire to
memorialize their agreement about the allocation of costs in the event the PG&E utility
lines or AT&T communication lines must be moved for future public purposes.
NOW, THEREFORE, in exchange for mutual consideration, the receipt of which
is hereby acknowledged, the parties agree as follows:
