C. 'I fJ "~>fW, fr>- r D~Q~~9Rt (IlLicenseelt). . . A. Zone 7 currently owns approximately 38 miles of flood control channels in the cities of Dublin, Livermore, and Pleasanton. This agreement shall cover all existing and future channels in the cities of Livermore and Pleasanton. B. Zone 7 currently owns approximately 505 acres of real property between the cities of Livermore and Pleasanton, south ofI-580 on El Charro Rd. This agreement will cover all existing and future lakes that will be acquired by Zone 7 in the Chain of Lakes System. C. The purpose of this License agreement is to permit fire and rescue training activities by Livermore Pleasanton Fire Deoartment upon Zone 7 property. Zone 7 and Licensee agree as follows: I. Authorization to Use. Zone 7 confers to Licensee a personal, non- exclusive and non-possessory license to enter upon and use certain real property under the control of Zone 7, as described in Exhibit A-I attached hereto and/or as otherwise authorized by Zone 7 (the "Zone 7 Property"), for the purposes and subject to the terms, conditions and restrictions set forth below. This Agreement does not constitute a grant of any ownership, leasehold, easement or other property interest or estate in the Zone 7 Property. 2. Use of Zone 7 Propertv. Licensee may enter and use the Zone 7 Property for conducting fire and rescue training activities. Licensee shall have access to the Zone 7 Property between the hours of 6:00 am to 6:00 pm seven days a week. Licensee shall comply with any conditions to approval or guidelines for use imposed in connection therewith, as set forth in Exhibit A, or as otherwise required by Zone 7. Zone 7 may change such guidelines as necessary to promote or protect the public safety, health or convenience. Zone 7 shall give reasonable notice of any such changes, subject to emergency situations. 3. . Restrictions on Use. Licensee shall use the Zone 7 Property for only those activities that are expressly permitted under Section 2 or by written authorization of the Zone 7. The term "Licensee" shall include Licensee, its officers; agents, employees, invitees, contractors or subcontractors, and their employees.. By way of example only and without limitation, the following uses of the Zone 7 Property by Licensee are prohibited: a) Licensee shall not construct or place any permanent structures or improvements on the Zone 7 Property, nor shall Licensee alter any existing structures, signs or improvements on the Zone 7 Property
