( • / <br />AGREEMENT FOR INSTALLATION AND MAIT•1TET~dANCE <br />OF LANDSCAPING <br />THIS AGREEMENT is made this. day: of clay , <br />19 ~[ _, between JOHN CLOSE _ <br />hereafter referred to as "Property Owner" and the CITY OF PLEASANTON, <br />a municipal corporation, hereafter referred to as "City°'. <br />R E C I T A L S <br />THIS AGREEMETT IS BASED. tiPON THT~ FOLLOWIT~tG FACTS: <br />(1) Property owner is ttie owner of real property. in the City of <br />Pleasanton described in Exhibit "A", attached to this Agreement and <br />made a part of it by this. reference;. <br />(2) On September 14 19 84 , the .City granted a <br />of Adjustment variance approval to said property; <br />Board <br />(3) By the terms of the Board of Adjustment approval, property <br />owner is required to in tall and maintain landscaping in accordance <br />with a plan, to be approved by the Planning Department prior to Build- <br />ing Permit approval; <br />(4) Both parties recognize that the installation and maintenance <br />of landscaping is an integral part of the property owner's plan for <br />development of the property. <br />NOW, THEREFORE, IT IS AGREED BETWEEDI THE PARTIES, as follows: <br />1. Furpose. The purpose of this Agreement is to assure (a) <br />installation in accordance with the landscaping plan previously <br />approved by the City and (b) continued maintenance and care of the <br />landscaping.. <br />
