<br /> <br />*~ <br />AN AC~2EF~:rTP TO PERMIT CON~7CTION TO AMID USE OF <br />C~fl'Y~SERVICE AREA R-1967-1 SEWERAGE TRANSMISSION FACII.,ITIES <br />A <br />COUNl'Y OF AI,AMEDA, CITY OF PLEASAN'IC~T AMID WII~LIAM C[JRRIlJ <br />TH S AGREEMENT is made and entered into as of this ~ day of <br />19 9 0 , by and among the CITY OF PLEASAN'ICIN (hereinafter referred ~, <br />to as "CITY"), the COUNTY OF AI,AMEDA (County Service Area R-1967-1) <br />(hereinafter referred to as "COUNTY") and WILLIAM CURRIN ( hereinafter <br />referred to as "PROPERTY OWI~~R") <br />~iSEIH <br />WHEREAS, COUNTY has forired County Service Area R-1967-1, hereinafter <br />referred to as "CSA", to provide, among other services, sesnrage services; and <br />~2EAS, CIT~•has agreed .to provide sewage treatment and effluent <br />export services for the•CSA, and in order to utilize said services, COUNTY <br />has constructed a new gravity sewer, force main and pump station; and <br />WHEREAS, CITY has entered into an agreement with CCX7NTY to operate and <br />maintain the CSA pump station and force main; and _ <br />Tri~;AS, CITY and PROPERTY OWNIIZ entered into a preannexation agreement <br />to require PROPERTY OWNER to comply with all City Ordinances, laws and <br />regulations, except chapter 17.36, Growth Management; and <br />WIIERF~AS, PROPERTY OF~2 desires to annex into CITY property located <br />east of Foothill Road and south of CSA, consisting of approximately 10 acres <br />in order to subdivide the. property for nine (9) residential lots; and <br />WHEREAS, PROPERTY OWNER has received frcan COUNTY conditional approval, <br />pursuant to Resolution 89-66, adopted 9/29/89, for a tentative map, Tract <br />5708, to subdivide the 10 acre parcel into nine (9) lots; and <br />WHEREAS, CS7[JNTY approved the map for Tract 5708, subject to Condition <br />.32, Resolution 89-66, which requires each lot must be connected to the <br />City's sewer system and approved by the CITY Director of Public Works; and <br />TriIHEE2EAS, CITY has required property OWDIER to connect to COUNTY's exist- <br />ing CSA sewer system prior to its flow into CITY's sewer system. <br />NOW, THEREFORE, in consideration of the ac)mowledgments made above and <br />mutual promises as provided herein, CITY, CO~AV'TY and PROPERTY OWNEEt agree as <br />follows: <br />
