Developer is the owner of certain real property in the City of Pleasanton,
commonly known as 900 Main Street (the Property); Developer has obtained City approval of a
conditional use permit and design review for the Property;
B. In connection with the project described above, City has asked Developer to
install a traffic signal at Vervais Avenue and Main Street and to insta112871ineal feet of 8" SDR
35 PVC sanitary sewer pipeline and two 48" standard manholes;
C. The traffic signal is one of the traffic improvements identified in the City's
Traffic Development Fee Ordinance, Chapter 3.20, Pleasanton Municipal Code;
D. City requirements applicable to the project's location require the use of specific
light standards and poles, and the City has, in December 1999, issued final approved plans for
the intersection; the Developer's general contractor advised Developer that there will be at least
a fourteen (14) to sixteen (16) week delay before the specified poles and controllers can be
delivered; as an interim measure, Developer's general contractor shall install temporary poles
and controllers so as not to interrupt the flow of traffic, and when the specified poles are
delivered, they will be installed as specified; the temporary installation and subsequent
permanent installation have resulted in increased costs;
E. Developer is willing to install the requested traffic signal and sewer line, subject
to reimbursement by City;
F. City has agreed that the delay in delivery of the specified poles and controllers
shall not hold up or delay Developer's rights to otherwise occupy the Property.
NOW, THEREFORE, IT IS AGREED as follows:
1.
