~.. <br />[RAF - vI - 6/18/80 - 25121/323-2] <br />• ~ ~ .,' <br />Y . <br />®®CUMENT <br /> <br />RELMIS: D-40.8-X (N) <br />AUDIT Na /~493~Z~ <br />THIS AGREEMENT, <br />of f~fgy 1980, by <br />and between SOUTHERN PACIFIC TRANSPORTATION COMPANY, a Delaware corpora•• <br />tion, herein termed "Railroad," and CITY OF PLEASANTON, a municipal <br />corporation of the State of California, address: City Hall, Pleasanton, <br />California, herein termed "City;" <br />RF.(' T'PA T.~ <br />The parties hereto desire to evidence by this <br />instrument their agreements with respect to the widen- <br />ing and improvement of Angela Street, Crossing No. D-40.8, <br />at or near Pleasanton, in the County of Alameda, State of <br />California. <br />AGREEMENT: <br />1. Railroad shall furnish the necessary labor, materials, tools <br />and equipment to relocate and/or modify the existing warning devices <br />at said crossing substantially as indicated on the print of Railroad's <br />Western Division Drawing P-1269, Sheet 1, dated March 20, 1980, attache:. <br />and made a part hereof. <br />2. Railroad, at City's expense, shall prepare its tracks, includ- <br />ing change of running rail, and the furnishing and installation of <br />timber planking along the rails of the tracks located through the cross••• <br />ing area. <br />3. City agrees to reimburse Railroad for one hundred percent (100'..) <br />for the cost and expense incurred by Railroad in furnishing materials <br />and performing the work specified in Sections 1 and 2 above. <br />4. City, at City's expense, shall furnish and install and there- <br />after maintain all paving on approaches to the crossing area, together <br />with all curbs, gutters and other street facilities. <br />5. City, at City's expense, shall reconstruct the drainage culver-I. <br />beneath said roadway as necessary for the widened roadway and., after <br />such reconstruction, shall maintain same at City's expense. <br />6. Following execution of this instrument,.. Railroad will order thy:. <br />delivery of all materials required to perform the work contemplated her~:- <br />in and shall submit to City a bill for eighty percent (800) of City's <br />share of the estimated cost of materials to be furnished by Railroad. <br />As soon as the crossing signals and/or the crossing surface have been <br />placed in operation, Railroad shall submit to City bills for eighty <br />percent (80$) of City's share of the estimated cost of applicable labor <br />-1- <br />
