Notwithstand- <br /> ing the provisions of Sections 15 . 1 . 1 through 15. 1 . 5 <br /> Declarant reserves the right to establish or cause to <br /> be established a District to maintain, repair, restore, <br /> manage and operate the Common Area. The costs incurred <br /> by the maintenance district shall be assessed against <br /> each Lot and collected with real property taxes in the <br /> manner provided by law. Upon formation of the District, <br /> the duty of the Association to maintain, repair, <br /> restore, operate and manage the Common Area or portions <br /> thereof included in the District shall terminate. <br /> 15.2 Powers. In addition to the powers enumerated <br /> C in its Bylaws, or elsewhere <br /> provided for herein, and without <br /> limiting the generality thereof, the Association shall have <br /> the following powers: <br /> 15 . 2 .1 Access . For the purpose of perform- <br /> ing any act reasonably related to the performance by <br /> the Association of its responsibilities, the Associa- <br /> tion' s agents or employees shall have the right to <br /> enter any Lot in case of emergency. <br /> 15 .2 .2 Assessments , Liens and Fines. The <br /> Association shall have the power to levy and collect <br /> Assessments in accordance with the provisions of <br /> Article XV. The Association may impose penalties <br /> against any Owner for failure to pay assessments or for <br /> -61- <br />
