determined in connection with the operational review <br /> pursuant to paragraph 12 . Notwithstanding the <br /> foregoing, the parties may provide, for Livermore's <br /> personnel to inspect the Collection System or portions <br /> thereof of the other party in pursuance of Infiltration <br /> and Inflow programs. <br /> Flow Limitation. Without limitation, neither party shall <br /> permit any act, or take any act, or allow any user to take <br /> action, or fail to take action, which would cause Livermore to <br /> exceed the limitations upon flow or any pollutant loading <br /> limitation set forth in Livermore's NPDES Permit, otherwise cause <br /> Livermore to be in violation of its NPDES Permit or wastewater <br /> discharge requirements. <br /> 8 . FEES AND CHARGES. <br /> (a) Connection Fees. From and after the effective <br /> date of this agreement, a connection fee for sewer service <br /> established by Livermore shall be levied and collected by <br /> Pleasanton in the Ruby Hill Project Area at the same rate as <br /> established in the Livermore Service Area. Nothing herein <br /> contained shall preclude Pleasanton from levying or retaining an <br /> additional charge or surcharge fee over the basic fee. <br /> (b) Service Charges. The same basic service charge as <br /> established for Livermore's Sewer Service Area to provide for <br /> maintenance and operation (including overhead) , repair and <br /> 12 <br />
