in this Agreement. Livermore shall reserve treatment capacity <br /> for said Ruby Hill Project. <br /> 4 . OWNERSHIP OF FACILITIES. <br /> (a) Pleasanton's Collection System. Pleasanton shall <br /> own, acquire, construct, improve, replace, repair, operate and <br /> maintain Pleasanton's Collection System within the boundary of <br /> Ruby Hill Project Area sewerage service area, and shall provide, <br /> acquire, construct, improve, replace, repair, operate and <br /> maintain at its own expense and in good condition, such <br /> Collection System as is or shall be necessary or appropriate to <br /> deliver sewage from the Ruby Hill Project Area to Livermore's <br /> Sewerage Facilities in such manner as to comply with all terms <br /> and conditions of this agreement, Livermore's NPDES Permit, <br /> Livermore's Wastewater Discharge Requirements of the Clean Water <br /> Acts and rules and regulations implementive thereof, including, <br /> but not limited to, provisions thereof requiring establishment <br /> and maintenance of a pretreatment program, and with all other <br /> applicable laws, rules and regulations. <br /> (b) Livermore's Sewerage Facilities. Livermore shall <br /> retain ownership of the Sewerage Facilities including, without <br /> limitation, Livermore's Treatment Plant and any and all <br /> easements, rights, and permits pertaining to Livermore's <br /> Collection System and Sewerage Facilities.
