City of Pleasanton–Spotorno Ranch Reduced Development Project
Environmental Checklist Initial Study/Consistency Checklist

88 FirstCarbon Solutions
https://adecinnovations.sharepoint.com/sites/PublicationsSite/Shared Documents/Publications/Client (PN-JN)/2148/21480021/Consistency Checklist/21480021 Spotorno Ranch Consistency Checklist ScreenCheck.docx
having yielded mortars, pestles, and arrowheads, and is likely a significant habitation site. While the
site is not located within the project boundary or in close enough proximity to potentially extend
into the project area, its presence in the vicinity indicates a higher probability for undiscovered
buried archaeological deposits within the project area, and coupled with poor soil visibility during
both surveys, increases the potential for undiscovered resources to be encountered during project
construction. Such resources could consist of but are not limited to stone, bone, wood, or shell
artifacts or features, including hearths and structural elements.
In addition to MM K2, the City of Pleasanton’s General Plan Policy 5 includes the following programs
to protect undiscovered resources:
Program 5.1 When reviewing applications for development projects, use information regarding
known archaeological finds in the Planning Area to determine whether an
archaeological study, construction monitoring or other mitigations are appropriate.
Require that archaeological studies meet the requirements of the California
Environmental Quality Act (CEQA) Guidelines Section 15064.5 in identifying
mitigation measures if an archaeological site is encountered. Include provisions for
the interpretation of cultural resources. Consult with the California Archaeological
Inventory, Northwest Information Center, as necessary.
Program 5.3 Continue to include a standard condition of project approval to require the cessation
of all construction and grading activities within the vicinity of any discovered
prehistoric or historic artifacts, or other indications of cultural resources, until any
such find is evaluated by a qualified professional Archaeologist, and appropriate
mitigation is approved by the City.
In compliance with Program 5.1, FCS conducted an archaeological survey of the project site. On the
basis of this survey, FCS recommends that MM K2 be refined to require monitoring of initial grading
activities. This enhancement would be included as a condition of approval , and would be shown on
the grading plan.
c) Human Remains
Would the project: Disturb any human remains, including those interred outside of formal
cemeteries?
The 1998 HVSP FEIR determined that buried human remains could potentially be discovered during
construction. According to the 1998 HVSP FEIR, if human remains are discovered during
construction, the project would comply with Sections 7505.5(b) of the California Health and Safety
Code, which requires the County Coroner to be responsible for contacting the Native American
Heritage Commission (NAHC) within 24 hours; and Public Resources Code Section 5097.98 and
Section 5097.99, which call for, “protection of Native American human burials and skeletal remains
from vandalism and inadvertent destruction.” The 1998 HVSP FEIR recommended construction
personnel on the project be instructed as to the potential for discovery of human remains, and the
need for proper and timely reporting of such finds, and the consequences of failure thereof.
