City of Pleasanton–Spotorno Ranch Reduced Development Project
Initial Study/Consistency Checklist Environmental Checklist

FirstCarbon Solutions 89
https://adecinnovations.sharepoint.com/sites/PublicationsSite/Shared Documents/Publications/Client (PN-JN)/2148/21480021/Consistency Checklist/21480021 Spotorno Ranch Consistency Checklist ScreenCheck.docx
According to the 1998 HVSP FEIR, compliance with the existing statute would protect against
significant adverse impacts.
No human remains or cemeteries are known to exist within or near the project site. However, there
is always the possibility that subsurface construction activities associated with the project, such as
trenching and grading, could potentially damage or destroy previously undiscovered human remains.
Accordingly, this is a potentially significant impact. Consistent with the 1998 HVSP FEIR, in the event
of the inadvertent discovery or recognition of any human remains, CEQA Guidelines Section 15064.5,
Health and Safety Code Section 7050.5, and Public Resources Code Sections 5097.94 and Section
5097.98 would be implemented. Therefore, the proposed project would not result in any peculiar
effects related to human remains and would not result in new or more severe impacts related to
human remains beyond what was previously analyzed in the 1998 HVSP FEIR.
e) Listed or Eligible Tribal Cultural Resources
Would the project: Cause a substantial adverse change in the significance of a tribal cultural
resource, defined in Public Resources Code Section 21074 as either a site,
feature, place, cultural landscape that is geographically defined in terms of the
size and scope of the landscape, sacred place, or object with cultural value to a
California Native American tribe, and that is listed or eligible for listing in the
California Register of Historical Resources, or in a local register of historical
resources as defined in Public Resources Code Section 5020.1(k)?
This question was not included in the 1998 HVSP FEIR. No determination was made in the 1998
HVSP FEIR regarding the significance level of impacts associated with tribal cultural resources as
defined in Public Resources Code 21074 or historical resources as defined in Public Resources Code
Section 5020.1(k). However, as discussed above, the 1998 HVSP FEIR included an analysis of historic
and archaeological resources as defined in CEQA Appendix K Section III and determined that there
would be no impact to Site CA-ALA-24. The 1998 HVSP FEIR concluded that impacts would be less
than significant with implementation of MM K2, which would reduce any potential impacts to
previously undiscovered historic or prehistoric resources that are encountered during construction.
An updated NWIC records search, review of the CRHR, local registers of historic resources, and the
NAHC Sacred Lands File failed to identify any listed Tribal Cultural Resources within the project site
that may be adversely affected by the proposed project.
As such, no recorded Tribal Cultural Resources will be adversely affected by the proposed project.
Therefore, the proposed project would not result in any peculiar effects related to listed or eligible
Tribal Cultural Resources and would not result in new or more severe impacts related to listed or
eligible Tribal Cultural Resources beyond what was previously analyzed in the 1998 HVSP FEIR.
