City of Pleasanton–Spotorno Ranch Reduced Development Project
Environmental Checklist Initial Study/Consistency Checklist

90 FirstCarbon Solutions
https://adecinnovations.sharepoint.com/sites/PublicationsSite/Shared Documents/Publications/Client (PN-JN)/2148/21480021/Consistency Checklist/21480021 Spotorno Ranch Consistency Checklist ScreenCheck.docx
f) Lead Agency Determined Tribal Cultural Resources
Would the project: Cause a substantial adverse change in the significance of a tribal cultural
resource, defined in Public Resources Code Section 21074 as either a site,
feature, place, cultural landscape that is geographically defined in terms of the
size and scope of the landscape, sacred place, or object with cultural value to a
California Native American tribe, and that is a resource determined by the lead
agency, in its discretion and supported by substantial evidence, to be significant
pursuant to criteria set forth in subdivision (c) of Public Resources Code Section
5024.1?
This question was not included in the 1998 HVSP FEIR. No determination was made in the 1998
HVSP FEIR regarding the significance level of impacts associated with tribal cultural resources as
defined in Public Resources Code 21074 or historical resources as defined in Public Resources Code
Section 5020.1(k). However, as discussed above, the 1998 HVSP FEIR included an analysis of historic
and archaeological resources as defined in CEQA Appendix K Section III and determined that there
would be no impact to Site CA-ALA-24. The 1998 HVSP FEIR concluded that impacts would be less
than significant with implementation of MM K2, which would reduce any potential impacts to
previously undiscovered historic or prehistoric resources that are encountered during construction.
On January 30, 2018, FCS sent a letter to the NAHC in an effort to determine whether any sacred
sites are listed on its Sacred Lands File for the project area. A response was received on March 1,
2018, confirming that the Sacred Lands File did not indicate the presence of Native American cultural
resources in the immediate project area. The NAHC included a list of six tribal representatives
available for consultation. To ensure that all Native American knowledge and concerns over potential
Tribal Cultural Resources that may be affected by the project are addressed, a letter containing
project information and requesting any additional information was sent to each tribal representative
on March 6, 2018. No responses have been received to date.
Tribal consultation efforts conducted by FCS did not identify additional Tribal Cultural Resources, and
no Tribal Cultural Resources meeting the criteria set forth in subdivision (c) of Public Resources Code
Section 5024.1. have been identified by the City of Pleasanton in its capacity as Lead Agency for the
project. As such, no additional significant Tribal Cultural Resources will be adversely affected by the
proposed project. Therefore, the proposed project would not result in any peculiar effects related to
lead agency determined Tribal Cultural Resources and would not result in new or more severe
impacts related to lead agency determined Tribal Cultural Resources beyond what was previously
analyzed in the 1998 HVSP FEIR.
FEIR Mitigation Measures
The following site development standards and design guidelines address cultural resources of the
HVSP and were adopted as mitigation measures as part of the 1998 HVSP FEIR (Appendix A).
MM K2 If previously undiscovered historic or prehistoric resources are encountered during
construction, work in the immediate area shall cease until such time that a qualified
