Item #10
CITY COUNCIL AGENDA REPORT

February 20, 2024
Public Works - Engineering Division

TITLE: ACCEPT PUBLIC IMPROVEMENTS PERFORMED BY JJ CONSTRUCTION &
DESIGN, INC. FOR THE LIGHTING IMPROVEMENTS FOR THE RAILROAD
PARKING LOT PROJECT, CIP NO. 20462 AND APPROVE A BUDGET
AMENDMENT IN THE MISCELLANEOUS CIP FUND

SUMMARY
The undeveloped gravel parking lot between St Mary and Division Streets has been utilized for
downtown business employees and overflow parking during special events. The City owns the
eastern part of the parking lot area, while the western 30 feet is owned by Union Pacific
Railroad (UPR). The City entered into a lease agreement with Union Pacific Railroad to include
a portion of its property as a part of safety improvements to the parking lot. The improvements
added decorative lighting, ADA-compliant parking stalls, and fencing. Two additional
streetlights were installed on St Mary Street, between the parking lot and Peters Avenue, to
improve lighting on the sidewalk. The City Council awarded the construction contract to JJ
Construction & Design, Inc. for $118,000 on December 20, 2022. Construction of the project is
complete to the satisfaction of the Acting Director of Public Works, and staff recommends the
City Council accept the project as complete.

RECOMMENDATION
1. Accept the project as complete and authorize the City Clerk to file a Notice of
Completion.
2. Authorize the release of the retention in the amount of $5,900 to JJ Construction &
Design, Inc. 30 days after the recordation of the Notice of Completion.
3. Authorize the return of the project’s balance of $40,281 back to the Miscellaneous CIP -
General Fund (Fund 201).

BACKGROUND
The parking lot adjacent to the railroad corridor between St Mary Street and Division Street
was identified as a temporary parking lot in the Downtown Parking Strategy and
Implementation Plan adopted by the City Council on April 18, 2017. The plan identified the lot
primarily for use by downtown business employees but also as an overflow parking area for
others during special events.

The parking lot comprises a City-owned parcel of land (APN 94-125-7-1) and a portion of
UPR’s parcel of land (APN 094-125-7-2). The City’s parcel has been undeveloped since the
construction of Anderson Street in 1990. The area has been used for temporary parking,
primarily during the Alameda County Fair. The Order of Demolay leased the western half of the
parking area from UPR for Alameda County Fair event parking until May 2021. In 2016, the
City added gravel, striping, and signage and promoted the use of the parking lot for downtown
Page 188 of 228
