City of Pleasanton—Merritt Property Project
15183 Consistency Checklist Consistency Checklist

105
The Housing Element Update FEIR concluded that, for construction activities
that disturb one or more acre of land surface, compliance with the National
Pollutant Discharge Elimination System (NPDES) General Permit for Stormwater
Discharges Associated with Construction and Land Disturbance Activities
(Order No. 2012-0006-DWQ) would require development and implementation
of a Storm Water Pollution Prevention Plan (SWPPP). The SWPPP would result in
erosion and sediment controls, runoff water quality monitoring, proper waste
disposal, implementation of approved local plans, control of construction
sediment and erosion control measures, and identification of maintenance
responsibilities, as well as non-stormwater management controls. In addition,
compliance with CBC, applicable Municipal Code requirements, as well as
goals, policies, and programs included as part of the General Plan, and the
Vineyard Avenue Corridor Specific Plan (as applicable) would reduce
potential soil erosion and loss of topsoil from construction-related soil
disturbance. As such, potential impacts related to soil erosion and loss of
topsoil would be reduced to less than significant levels.
Proposed Project Analysis and Conclusion
As discussed above, the proposed project would be required to implement
General Plan Public Safety Element Goal 1, Policy 2, and Goal 2, Policy 5 to
mitigate and minimize the risk of soil erosion and its effects. In addition, the
proposed project would adhere to the NPDES General Construction Permit
which contains requirements for erosion control of exposed soils, through the
application of BMPs from the project-specific SWPPP. Lastly, per General Plan
Program 2.2, the proposed project would be required to implement all
erosion control measures recommended in the Geotechnical Investigation
prepared for the proposed project, including those for surface and
subsurface drainage (Appendix E). Environmental effects would be avoided
by the imposition of uniformly applied development policies and standards.
Therefore, development of the site as proposed would not result in any
environmental effects that are peculiar to the proposed project. The
proposed project would not result in a new or more severe adverse impact
that was not previously identified in the Housing Element Update FEIR.
