City of Pleasanton—Merritt Property Project
15183 Consistency Checklist Consistency Checklist

87
c) Burial Sites
Would the project: Disturb any human remains, including those interred outside of
formal cemeteries?
Summary of Housing Element Update FEIR
The Housing Element Update FEIR indicated that excavation and
construction activities consistent with the Housing Element Update may
uncover human remains that may not be marked in formal burial locations.
Therefore, new development could result in a potentially significant impact
on human remains, including those outside of formal cemeteries.
The Housing Element Update FEIR concluded that compliance with
applicable goals, policies, and programs in the General Plan, as well as
compliance with applicable current State, federal and local regulations,
including Public Resources Code 5097 and CEQA Guidelines Section
15064.5(d)—Effects on Human Remains, Health and Safety Code Section
7050.5, would ensure that future development consistent with the Housing
Element Update would not result in significant adverse effects to human
remains. Therefore, the Housing Element Update FEIR concluded the impacts
would be less than significant.
Proposed Project Analysis and Conclusion
Results of the records search did not identify any human remains or
cemeteries within the project site or a 0.25-mile radius of the project site. In
addition, the pedestrian survey failed to identify any human remains or
cemeteries. There is always the possibility that ground-disturbing activities
during construction may uncover previously unknown, buried human
remains.
FCS identified project-specific requirements based on the results of the
record search and pedestrian survey. In compliance with General Plan
Program 5.1 and 5.2, FCS determined that archaeological and TCR training
for construction staff shall be required prior to the start of any ground-
disturbing activities in case any resources are inadvertently discovered.
Furthermore, it is recommended that a qualified Archaeologist be present to
monitor during the clearing and grubbing phases of ground disturbance to
check for the inadvertent exposure of possible cultural materials. In the event
exposed soils indicate cultural materials may be present, this may be
followed by regular or periodic archaeological monitoring as determined by
