In addition, the studies and Capital Improvement Program identified capital
projects are necessary to meet the goals, programs, and objectives within the City's
General Plan; and
WHEREAS, on December 3, 2024, the City Council adopted amendments to
Pleasanton Municipal Code (PMC) Chapter 17.40 – Affordable Housing Fee, and
Chapter 17.44 – Inclusionary Zoning Ordinance, which modified the City’s requirements
for inclusion of affordable housing units in market-rate residential projects; and
WHEREAS, there is a need, particularly in the near-term, to reduce impediments
to the production of multi-family housing units and promote residential development in
conformance with the Housing Element so as to meet the housing needs of all
segments of the community; and
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of
Pleasanton, based on the entire record of proceedings, including the oral and written
staff reports and all public comment and testimony:
Section 1: Findings Pursuant to the California Environmental Quality Act (CEQA)
The approval and adoption of the Nexus Studies and the adoption of an Updated
Master Fee Schedule is not a project within the meaning of Section 15378 of the
California Environmental Quality Act (CEQA) Guidelines because there is no potential
for it to result in a physical change in the environment, either directly or indirectly, in that
the resolution provides only for the adoption of amendments to existing fees imposed on
new development. Additionally, it is also exempt from CEQA pursuant to CEQA
Guidelines Section 15061(b)(3) because it can be seen with certainty that there is no
possibility of a significant effect on the environment and contains no provisions that will
directly or indirectly result in a physical change in the environment.
