P24-0670, -0671, and -0672, 1803 Santa Rita Road Planning Commission
11 of 12
supported, the proposed restaurant would be required to meet the maximum noise limit in the
PMC of 70 dBa at the property plane.

For informational purposes, the General Plan prescribes the following noise thresholds:

• For residential uses, up to 60 Ldn2 is normally acceptable, while 60 to 75 Ldn is
conditionally acceptable; and
• For commercial uses, up to 70 Ldn is normally acceptable, while 70 to 80 Ldn is
conditionally acceptable.

The General Plan further indicates the closest residential uses currently experience 65 dBa
Ldn given their adjacency to Santa Rita Road.

Architectural Design
Only minimal color changes are proposed for the existing building, which include changing the
metal roof and building cornice colors from white to yellow (corporate colors). Previously, the
roof and portions of the building’s walls were painted red when occupied by KFC. These
changes would not drastically change the visual aesthetic of the existing building or the
surrounding area. Therefore, staff believes the architectural design is appropriate.

Signage
As described above, a total of four illuminated wall-mounted signs (one on each elevation) and
some on-site drive-through directional signage is proposed (see Exhibit B). The wall-mounted
signage is designed in the corporate stylings of Philz Coffee and is trademark protected.
Based on the design of the proposed signage (halo illumination), minimal glare would be
created in the evenings and would not create a visual nuisance. Therefore, staff believes the
proposed signage is appropriate.

ALTERNATIVES
As articulated above, staff believes the proposed use, as conditioned, would be consistent with
the objectives of the zoning district. However, alternatives that could be considered by the
Planning Commission include:

1. Denial of the application. Such an action would preclude the applicant from operating the
drive-through coffee restaurant; or

2. Approval of the CUP with modifications. The Planning Commission could approve the CUP,
but with modified hours of operation and/or other changes to the proposal.

Staff is able to support the findings to approve the proposed use, as proposed, and believes
the project would not adversely impact any existing on-site uses or the surrounding area; thus,
staff suggests neither of the two project alternatives above should be pursued.

PUBLIC NOTICE
Notice of this application was sent to surrounding property owners and tenants within a
1,000-foot radius of the subject parcel and published in the newspaper. At the time this report
was published, staff had not received any public comments.

2 The day-night average sound level is the average noise level over a 24-hour period.
