City of Pleasanton—Villages at the Quarry Project
15183 Consistency Checklist Consistency Checklist

137
The presence of a REC at the project site constitutes a potentially significant
impact. Because of the identified REC at the project site, the Phase I ESA
recommended further investigation and remediation at the project site. As
discussed above, the Housing Element Update FEIR identified MM HAZ-2,
which requires the preparation of a Phase I ESA. Additionally, MM HAZ-2
requires the preparation of a Phase II ESA in the event that further
investigation and remediation is needed at the project site. MM HAZ-2 further
requires that, prior to receiving a certificate of occupancy, documentation
from the applicable overseeing agency shall be issued indicating that all
required remediation has been completed and no further action is required.
A Removal Action Completion Report (Appendix F) was completed in May
2024, which outlines the remedial excavation activities conducted in
accordance with the DTSC-approved RAW for the project site. Remedial
excavation activities were performed between February 1, 2024 and March
8, 2024, resulting in approximately 18,231 tons of contaminated soil being
transported off-site for disposal. Based on the results from soil samples
obtained during remediation as well as post-excavation confirmation
sampling, the identified contaminated soils have been removed and residual
concentrations are below DTSC-approved Removal Goals.
The DTSC issued an RA Certification Form on September 4, 2024 (Appendix F).
As the form details, the DTSC has determined that all appropriate response
actions have been completed, that all acceptable engineering practices
were implemented, and that no further removal is necessary.20 Full
compliance with MM HAZ-2 has been achieved with DTSC’s formal approval
of the RA Completion Report. Compliance with applicable federal, State,
and local regulations regarding hazardous materials, including the Hazardous
Materials Transportation Act, California Public Resources Code, and General
Plan, would reduce and limit the associated risks. Similarly, any handling,
transporting, use, or disposal of hazardous materials during demolition,
construction. or operation would comply with applicable laws, policies, and
programs set forth by various federal, State, and local agencies and
regulations, including, but not limited to, the EPA, RCRA, Caltrans, the LHMP,
Title 22 and 26 of the California Code of Regulations governing hazardous
materials transport, and Title 19 of the California Code of Regulations and
Chapter 6.95 of the Health and Safety Code for site remediation.

20 California Department of Toxic Substances Control (DTSC).
