November 8, 2024

• Under the Agreement for Wastewater Disposal Services dated November 3, 1992, DSRSD
provides wastewater treatment services to the City of Pleasanton. DSRSD understands that the
City of Pleasanton may be conducting separate studies and analysis regarding the Arroyo Lago
development that could involve evaluating potential annexation of the project to the City. Per
the 1992 agreement, any future plans for either a temporary emergency or future connection to
the City of Pleasanton’s wastewater collection system would require coordination and review
with DSRSD.
In addition, any connection to the City of Pleasanton collection system would require use of the
Livermore-Amador Valley Water Management Agency system for disposal of the treated
wastewater. The Amended and Restated Joint Exercise of Powers Agreement for the Livermore-
Amador Valley Water Management Agency (LAVWMA) dated September 10th, 1997, requires
unanimous approval of the LAVWMA Board for a member agency to provide wastewater service
to unincorporated areas of Alameda County. Therefore, an Out of Service agreement with the
City of Pleasanton to serve the Arroyo Lago project would also be subject to review and
approval by the LAVWMA Board since the proposed development is currently located in
unincorporated Alameda County.
• The Wastewater Balance Technical Memorandum prepared by EKI Environmental & Water, Inc.
(Appendix K) was not included in the DEIR that was released for public review. During this
review period, DSRSD requested the missing Appendix K and was provided with a modified
Appendix J that was not available for public review. For a fully comprehensive review the
modified Appendix J should be available for public review and comment.
DSRSD looks forward to reviewing the final EIR for the Project. Should you have any questions
concerning the above, please contact Jaclyn Yee at (925) 875-2258.
Sincerely,

Jaclyn Yee
Senior Engineer

cc: Jan Lee, DSRSD General Manager
Steve Delight, DSRSD Engineering Services Director
Elke Rank, Zone 7 Water Agency
Colleen Winey, Zone 7 Water Agency
Michael Stella, City of Pleasanton
Michelle Walden, Alameda County Water District
