Page 24

85. TITLE ISSUES. Referring to the CLTA Preliminary Report by First American Title
Company, the applicant shall address the following title questions (address the
following conditions prior to map approval):

a. Exception 6 discusses a Pacific Bell easement for Communications Equipment
recorded on 11-13-2019 as Instrument No. 2019-231843. General Note 4 on
Sheet 3 of the CBG plans suggests that this easement will be
“removed/quitclaimed”. Evidence that AT&T (formerly Pacific Bell) is willing to
quitclaim their easement rights has been provided. Once the quitclaim deed is
recorded with Alameda County, provide the quitclaim deed and reference on
the map.

86. PUBLIC SERVICE EASEMENT. A 10-foot wide Public Service Easement (PSE) shall
be granted to the City across the Black Avenue frontage of the property and all other
areas where public infrastructure is installed in accordance with Pleasanton Municipal
Code §19.24.190 and 19.36.110. PSEs shall be offered as an easement for public
purposes including but not limited to installation, construction, access, and
maintenance of all public services facilities above and below the ground surface
including poles, wires, conduits, vaults, cabinets, sanitary sewers, storm drains, gas
lines, and water lines as well as all those public utilities and appurtenances thereto as
subject to regulation under Pleasanton Municipal Code Chapter 13.04. Consistent with
California Government Code Section 66439(d)(3), the offer shall include the
statement, “The real property described below is dedicated as an easement for public
purposes…”
(Address this condition prior to map approval).

87. HORIZONTAL SETBACK FROM OVERHEAD ELECTRICAL LINES. Pacific Gas &
Electric Company (PG&E) operate joint utility poles and overhead electrical lines
along the Black Avenue frontage of the property. PG&E requires a safe working
clearance from active overhead lines depending on the nominal line-voltage of the
suspended wires. Because the proposed height of the building will place the northern
exterior walls in close proximity to the electrical lines, the applicant shall determine the
required setback from the suspended wires. A PG&E letter confirming the setback is
required to be submitted to the City. If the required setback from PG&E overhead line
is not achieved, the applicant shall either adjust the locations of the buildings to
achieve compliance, or shall place said joint utility pole facilities underground.
(Address this condition prior to plan approval).

88. SANITARY SEWER NETWORK. Capacity in the City’s sanitary sewer network to
serve the subject development must be verified by running a scenario in the City’s
network computer model. The computer model is operated by a consultant retained
by the City. The consultant will run the scenario and then issue a report with their
Docusign Envelope ID: 52DE2131-F0C9-4C18-86DD-6B9E7ADA8792
