P22-0902/11991 Dublin Canyon Road Planning Commission
2 of 6
would include an on-site parking lot with 43 spaces, a new bioretention area, and an off -site
emergency vehicle turnaround.

The proposed restaurant would be located on the lower northern slope of a hillside site. Under
the California Environmental Quality Act (CEQA) Guidelines, an IS/MND has been prepared to
assess the impacts on Biological Resources, Geology and Soils, Hydrology and Water Quality,
etc. The analysis found the proposed development will not significantly affect the environment
due to the required mitigation measures.

BACKGROUND
Previous Approval
The restaurant project was previously proposed in 2009 by the same applicant and property
owner. The Planning Commission approved the project in March 2009. However, the owner
did not obtain permits to construct the project, and the approval expired.

Measure PP
Pleasanton voters passed the Save Pleasanton’s Hills and Housing Cap Initiative (Measure
PP) in the November 2008 general election. Measure PP prohibits grading for and placing
structures on hillside slopes of 25 percent or greater or within 100 vertical feet of a ridgeline.

During the 2009 Planning Commission review of the restaurant proposal, in review of the
language and intent of Measure PP and based on the unusual circumstances of the project
site, the Planning Commission found the proposed project met the General Plan and the intent
of Measure PP. The project site has areas with man-made slopes greater than 25 percent as a
result of Caltrans's widening of Dublin Canyon Road in the mid-1970s. Additionally, the
proposed restaurant building will be constructed on a portion of the site with a slope less than
10 percent, and parking lots are not subject to Measure PP. Therefore, the project site is not
subject to Measure PP hillside development restrictions.

Site Description and Current/Surrounding Uses
The project site is approximately 1.06 acres of undeveloped land. An existing concrete
drainage ditch bisects the site. A 24-inch-diameter Coast Live Oak tree is on-site, along with a
bank of oak woodland located to the west and south of the project site . A private paved
roadway is situated along the project site's western boundary, providing access to the site and
the existing residence to the south. The project site is steeply sloped on the northern portion,
with a much less sloped knoll in the southern portion.

The project site is located on the southwest corner of Foothill Road and Dublin Canyon Road.
The Marriott Hotel is located north of the subject site, across Dublin Canyon Road.
Commercial/office buildings are located to the east across Foothill Road. A single -family
residence and the Kolb Ranch development are located south. An undeveloped parcel is
situated to the west. Adjacent to the project site are additional commercial office buildings. The
West Pleasanton/Dublin BART station is approximately 0.6 miles from the subject site.
