Transfer of Regional Housing Needs Allocations and Credits – Merritt Property Annexation
Page 3
March 17, 2026

1. The County’s RHNA obligation will be reduced by 18 Above-Moderate-Income units
associated with the Merritt Property, and the City’s RHNA obligation will be increased by
18 Above-Moderate-Income units.

2. The City of Pleasanton will be entitled to receive RHNA credit for all residential units
ultimately constructed on the Merritt Property following annexation (February 4, 2026).

3. The agreed-upon methodology is based on the current County General Plan designation
and existing development conditions.

The County of Alameda and the City of Pleasanton intend for this agreement to be binding and
enforceable and agree to cooperate in good faith to submit it to the COG within the statutory
timeframe.

Findings for Approval

1. Consistent with Government Code Section 65584.07(d)(1), the Merritt Property
annexation was approved on February 4, 2026 (Attachment 1), after ABAG made its final
RHNA allocation for the 2023-2031 housing cycle. ABAG approved the final 2023-2031
RHNA allocation plan in December 2021.

2. The County of Alameda and the City of Pleasanton are now jointly submitting a request
for an extension of the statutory 90-day deadline, as authorized by Government Code
Section 65584.07, subdivision (d)(2)(A). This RHNA transfer request is being submitted
within the statutory period. Therefore, the RNHA transfer request is timely and not time-
barred.

This City-County RHNA transfer agreement is submitted pursuant to Government Code
Section 65584.07(d)(1), and the Merritt Property annexation area was not incorporated in
the methodology used to allocate the City’s share of the regional housing needs,
consistent with Government Code Section 65584.07, subdivisions (d)(2)(A) and (d)(3)). In
ABAG’s 2023-2031 RHNA methodology, unincorporated areas in the County of Alameda
were “assigned” to the County for purposes of RHNA responsibility. The Merritt Property
annexation area was unincorporated County land until the City annexed it as of February
4, 2026. Based on the active application submitted to the City of Pleasanton in December
2022, the City included this site in its Housing Element inventory and Program 1.10,
which affirmed the City’s commitment to finalizing its project review by August 2024, a
deadline that was met. Further, as required by Government Code Section 65584.07
(d)(2)(A), the County-City RHNA transfer does not reduce the total regional housing or
change the RHNA for any jurisdiction other than the County of Alameda and the City of
Pleasanton.
