ARROYO LAGO RESIDENTIAL PROJECT
ADDENDUM

FCS 87
Https://adecinnovations.sharepoint.com/sites/PublicationsSite/Shared Documents/Publications/Client (PN-JN)/2148/21480036/Addendum/21480036 Arroyo Lago Residential Project Addendum.docx
Therefore, under Design Option B, the County Project would be required to implement MM BIO-2a 25
and MM BIO-2b, which include obtaining a Construction General Permit from the RWQCB, preparing
a Storm Water Pollution Prevention Plan (SWPPP), and implementing BMPs. Additional measures
require installation of silt fencing and straw wattles, monitored by a qualified Biologist, and post-
construction stormwater management to prevent pollution and hydromodification. Therefore, the Prior
FEIR concluded that impacts with respect to any riparian habitat or other sensitive natural community
would be less than significant with mitigation incorporated. (Draft EIR, pp. 3.3-28, 6-13).
Proposed Project Analysis and Conclusion
Similar to the County Project, 5.87 acres of Fremont poplar and mixed willow stands, as well as a
drainage swale, which contains riparian habitat, are located east of the project site. The proposed
bioretention area and detention basin, to be located off-site east of the proposed residential
development portion of the project site, would be in close proximity to the existing drainage swale and
associated riparian vegetation. As such, the proposed project could result in pollutant loading,
increased erosion and sedimentation, and trash or debris dispersal in the adjacent drainage swale. As
such, MM BIO-2a and MM BIO-2b would still be required to reduce potentially significant impacts to
sensitive riparian areas and water quality in the drainage swale. With the implementation of these
mitigation measures, impacts on riparian habitats or other sensitive natural communities would be
reduced to a less than significant level. Therefore, the proposed project would not introduce new
significant impacts or create substantially more severe significant impacts than those previously
identified in the Prior FEIR. No additional analysis is required.
c) Federally Protected Wetlands
Would the project: Have a substantial adverse effect on State or federally protected
wetlands (including, but not limited to, marsh, vernal pool, coastal,
etc.) through direct removal, filling, hydrological interruption, or
other means?
Prior FEIR Conclusions
The Prior FEIR found that the County Project would avoid any direct or indirect impacts to State or
federally protected waters and/or wetlands because the County Project would not impact the water
quality of the potential depressional wetland within the eastern portion of the Study Area, which is the
only potential jurisdictional feature within the project site. The closest proposed project component, a
storm drain outfall, would be located more than 120 feet from the potential depressional wetland
feature and would not result in direct or indirect impacts. Therefore, the Prior FEIR concluded that
impacts would be less than significant. (Draft EIR, pp. 3.3-35, 6-13).

25 Note: The National Pollutant Discharge Elimination System (NPDES) was inadvertently misidentified as the “National
Pollutant Discharge Effluent Standards” in MM BIO-2a of the Prior FEIR. MM BIO-2a, as detailed below, has been
revised to correct this minor typographical error.
